These Terms of Service ("Terms") govern your access to and use of the ArcBig platform and services (the "Service") provided by Arcbig Solutions Private Limited, an unlisted private limited company incorporated in India on 23 May 2024 ("ArcBig", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
ArcBig is a marketing platform that helps businesses and agencies plan, create, publish, schedule, and analyse marketing content across connected social and business channels, and manage related workflows such as approvals, messaging, and reporting.
You retain ownership of the brand assets, briefs, and content you provide ("Your Content"). You grant ArcBig a limited, non-exclusive licence to host, process, adapt, and publish Your Content solely to provide the Service — including producing creatives and publishing to the channels you connect and approve. Deliverables we create for you are yours upon payment, subject to any third-party assets (e.g., stock, fonts) that carry their own licences.
The Service lets you connect third-party accounts (such as Facebook, Instagram, and Google Business Profile). Your use of those platforms remains subject to their terms and policies. We publish, schedule, or manage content and messages only as you or your authorised users configure or approve. You are responsible for ensuring your use of connected platforms complies with their policies.
Where you enable auto-pilot or scheduled posting, you authorise ArcBig to publish approved or planned content on your behalf at the configured times. Where approval is required, content is published only after you or your authorised users approve it. You are responsible for reviewing planned content and for the content that is published to your channels.
If you use messaging or broadcast features, you represent and warrant that you have obtained all required consents and opt-ins from recipients, that your messages comply with applicable law and platform policies (including WhatsApp Business policies), and that you will honour opt-out requests. Messaging via third-party platforms may incur charges billed by those platforms to your own accounts. You are solely responsible for the lawfulness of contacts you upload and messages you send.
You agree not to use the Service to: violate any law or third-party rights; upload or publish unlawful, infringing, deceptive, or harmful content; send unsolicited or non-consented messages; misuse trademarks or others' brands; attempt to breach security; or interfere with the Service. We may suspend or remove content or accounts that violate these Terms or platform policies.
The Service, including its software, design, and content (excluding Your Content), is owned by ArcBig and its licensors and is protected by law. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.
The Service relies on third-party providers (payment processing, hosting, storage, messaging, and the connected platforms). We are not responsible for the acts, omissions, availability, or policies of third parties, and their services are governed by their own terms.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content will achieve any particular result or reach.
To the maximum extent permitted by law, ArcBig will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business, arising from or related to the Service. Our total liability for any claim will not exceed the amount you paid to us for the Service in the three (3) months preceding the claim.
You agree to indemnify and hold harmless ArcBig from claims, damages, and expenses arising from Your Content, your contact data and messaging, your use of connected platforms, or your breach of these Terms or applicable law.
You may cancel your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law or platform requirements. Upon termination, your right to use the Service ends; certain provisions (e.g., ownership, disclaimers, liability, indemnity) survive.
These Terms are governed by the laws of India. The courts at Ghaziabad, Uttar Pradesh, India will have exclusive jurisdiction over any disputes, subject to any applicable arbitration or consumer-protection provisions.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where required, provide additional notice. Continued use after changes means you accept the updated Terms.
